Eligibility & account

You must be at least the age of majority in your jurisdiction to make a purchase. You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use.

Products, pricing & orders

We strive to display products, sizes, framing options, and prices accurately. Occasional errors may occur; we reserve the right to correct pricing or descriptions and to cancel or refuse orders placed at an incorrect price or under erroneous terms, including after an order is submitted (we will notify you and refund any charge if applicable).

An order is an offer to purchase. We may accept or decline orders for any reason, including product availability, suspected fraud, or shipping limitations. When payment is captured and we confirm fulfillment, that acceptance forms the contract for those line items.

Payment

Payments are processed by our third-party payment processor. You authorize us and our processor to charge your payment method for the total at checkout, including applicable taxes and shipping where quoted. You represent that you are authorized to use the payment method provided.

Shipping & fulfillment

Shipping timelines, carriers, and fulfillment partners are described on our Shipping & Policies page and in order communications. Risk of loss passes to you when the carrier takes possession unless otherwise required by law.

Returns & refunds

Returns and refunds are governed by our Returns & Refunds policy, which is incorporated into these Terms by reference.

Intellectual property

All content on the Site — including images, text, logos, and design — is owned by us or our licensors and is protected by copyright and other laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission, except for personal, non-commercial viewing or as allowed by law. Purchased prints are licensed for personal display; commercial use requires separate agreement.

Disclaimer of warranties

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT ALLOWED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Indemnity

You agree to defend, indemnify, and hold harmless Good & Faithful Art and its owners and service providers from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any third-party rights.

Governing law & disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Exclusive jurisdiction and venue for disputes shall be in the state or federal courts located in Utah, except where prohibited by law. You waive any right to a jury trial where allowable.

Changes

We may modify these Terms at any time. The updated “Last updated” date reflects the current version. Continued use of the Site after changes constitutes acceptance. Material changes may be communicated by email or a notice on the Site where appropriate.
